1. Overview

Welcome to www.holtsinsurance.com (the “Site”), operated by Sakura Holt, Independent Insurance Broker(“we,” “us,” or “our”). The Site provides information about life insurance, annuities, and related financial products, and allows prospective clients to contact us and request quotes. The Site does not sell products or process payments online.

These Terms of Service (“Terms”) govern your access to and use of the Site. By visiting or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

2. Eligibility; Your Responsibilities

You represent that you are at least the age of majority in your state of residence or have the consent of a parent/guardian. When you submit information (for example, to request a quote), you agree that it is accurate, current, and complete and that you have the right to provide it. You are responsible for any activity conducted using your information or (if applicable) your account credentials.

3. Informational Nature of Site; No Binding Transactions

The Site is for informational and contact purposes only. The Site does not provide personalized financial, legal, tax, or medical advice; does not bind coverage; and does not complete insurance transactions online. Any product descriptions are illustrative and subject to carrier underwriting, eligibility, state availability, and licensing requirements. Final terms, conditions, and premiums are determined by the issuing insurance carrier.

4. Quotes and Estimates

Any quotes or illustrations are non-binding estimates based on the information you provide and carrier assumptions that may change. Eligibility, rates, coverage amounts, riders, and approvals are determined solely by the carrier after application and underwriting. We do not guarantee the availability, approval, or cost of any coverage.

5. Licensing and Geographic Limitations

Insurance services are offered only in jurisdictions where we are properly licensed and where products are approved for sale. Nothing on the Site constitutes a solicitation to buy or sell insurance in any jurisdiction where such offer or solicitation would be unlawful or unlicensed.

6. Intellectual Property

All original text, graphics, and other content created by or for us on the Site are owned by us and protected by law. Third-party names, logos, and marks (e.g., insurance carriers) are the property of their respective owners and used for identification only. You may not copy, distribute, modify, or create derivative works from Site content without prior written permission.

7. Third-Party Links and Tools

The Site may link to third-party websites or provide access to third-party tools. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party sites or tools is at your own risk and subject to their terms and privacy policies.

8. Privacy

Personal information you submit through the Site is governed by our Privacy Policy. The Site may use cookies and analytics services as described there.

9. Feedback

If you submit suggestions, ideas, reviews, or other feedback, you grant us a non-exclusive, perpetual, irrevocable, royalty-free license to use, reproduce, adapt, and display that feedback for any lawful purpose without compensation to you.

11. Communications Consent (Email/Phone; TCPA)

By submitting your contact information on the Site, you consent to be contacted by a licensed insurance professional via the methods you provide (including email and telephone calls) for the limited purpose of responding to your inquiry, discussing insurance options, and servicing your request. Standard carrier rates may apply. You may opt out at any time by replying “STOP” to text messages (if applicable) or by emailing sakura.holt@outlook.com.

Note: We do not use prerecorded or autodialed telemarketing campaigns. If that ever changes, we will obtain any additional consent required by the Telephone Consumer Protection Act (TCPA) before doing so.

12. Electronic Records and Signatures (E-Sign)

If we present documents or disclosures electronically (e.g., via email or secure portal), you agree to receive records electronically and to use electronic signatures where permitted by law. You may withdraw E-Sign consent or request paper copies by contacting sakura.holt@outlook.com. Some documents may still require wet signatures depending on carrier or state requirements.

13. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow limitations on implied warranties or exclusion/limitation of certain damages; in such jurisdictions, some limitations above may not apply.

15. Indemnification

You agree to defend, indemnify, and hold harmless Sakura Holt, Independent Insurance Broker, and our affiliates, officers, agents, and representatives from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any law or third-party right.

16. No Client Relationship; No Professional Advice

Your use of the Site and communications with us through the Site do not by themselves create a broker-client relationship. Decisions about insurance should be made based on your circumstances and the final policy contract issued by the carrier. You should consult your own legal, tax, or financial advisors as needed.

17. Suspension or Modification

We may modify, suspend, or discontinue any part of the Site at any time without notice or liability. We may also restrict or terminate access by any user who violates these Terms or applicable law.

18. Governing Law; Venue

These Terms are governed by the laws of the State of Alaska, without regard to conflicts of law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Alaska for any dispute arising out of or relating to these Terms or the Site.

19. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with a new “Last Updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
